Welcome to DreamFlix.
These Terms of Use Agreement ("Terms," "Agreement") govern your access to and use of DreamFlix, an artificial-intelligence-powered creative platform operated by ELDRAGA DIGITAL SOLUTIONS ("ELDRAGA," "DreamFlix," "we," "us," or "our").
DreamFlix is available through https://dream-flix.com, including its website, applications, tools, software, APIs, AI generation features, and other services that link to these Terms (collectively, the "Service").
Please read these Terms carefully before using DreamFlix.
By accessing or using the Service, creating an account, buying credit, uploading content, submitting an AI prompt, or otherwise interacting with DreamFlix, you agree to be bound by these Terms and our Privacy Policy.
Privacy Policy: https://dream-flix.com/privacy-policy
If you do not agree to these Terms, you must not access or use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your country to use an online service like DreamFlix if higher, to create an account or use DreamFlix.
If you are under 18, or under the age of majority where you live if higher, you may use DreamFlix and buy credit only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.
By using the Service, you represent that:
- you meet the applicable age requirement;
- you have the legal capacity to enter into this Agreement, or your parent or legal guardian has agreed to it for you;
- you are not prohibited from using the Service under applicable law; and
- the information you provide to DreamFlix is accurate and current.
If you are accessing DreamFlix on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "your" include that entity.
2. The DreamFlix Service
DreamFlix sells image and video generation services. You create characters, objects, places, and scenes, and DreamFlix generates the images, videos, voices, and music for them and joins your scenes into a movie. You pay for each generation with credit you buy in advance.
DreamFlix also lets anybody watch the movies that users have published. Published movies are shown with advertising.
The particular models, technologies, generation methods, features, resolutions, processing speeds, usage limits, and capabilities available through DreamFlix may change over time.
We may:
- introduce new features;
- modify existing features;
- change or replace underlying AI models;
- discontinue models or features;
- impose reasonable technical or usage limits;
- modify processing capacity;
- temporarily suspend features for maintenance or security; and
- make other changes necessary to operate and improve the Service.
We do not guarantee that any particular AI model, feature, generation method, processing speed, or capability will remain available indefinitely.
3. Your DreamFlix Account
Certain features require you to create an account.
You agree to provide accurate, complete, and current information when creating your account and to keep that information up to date.
You are responsible for:
- keeping temporary verification codes confidential;
- maintaining the security of your account;
- all activity occurring through your account;
- notifying us promptly of unauthorized access; and
- ensuring that your account is not used in violation of these Terms.
You may not sell, transfer, rent, or share your account or temporary verification codes with another person unless DreamFlix expressly permits such use.
We may suspend or terminate accounts that contain materially false information or are used in violation of these Terms.
4. Your Content
For purposes of these Terms, "Your Content" means content that you submit, upload, transmit, store, create, or otherwise make available through DreamFlix.
Your Content may include:
- prompts;
- text;
- photographs;
- images;
- videos;
- audio;
- files;
- reference material;
- project data; and
- other materials you submit to the Service.
You retain your rights in Your Content, subject to the rights and licenses granted to us under these Terms.
You are solely responsible for Your Content and for ensuring that your use of it through DreamFlix complies with applicable law and does not violate the rights of another person or organization.
5. Your Rights and License to DreamFlix
You represent and warrant that you have all rights, permissions, licenses, and consents reasonably necessary for you to submit and process Your Content through DreamFlix.
By uploading or submitting Your Content, you grant ELDRAGA a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, process, modify, transform, and otherwise use Your Content solely as reasonably necessary to:
- operate the Service;
- provide requested AI generation and editing features;
- process your prompts and inputs;
- generate and deliver Outputs;
- maintain and secure the Service;
- prevent fraud and abuse;
- enforce these Terms;
- provide customer support; and
- otherwise provide functionality you request.
This license exists only for as long as reasonably necessary for those purposes.
We do not obtain ownership of Your Content merely because you use DreamFlix.
6. AI Inputs and Outputs
DreamFlix uses artificial intelligence to process information submitted by users and produce generated results.
For these Terms:
"Input" means prompts, instructions, uploaded material, reference media, text, images, videos, audio, or other information submitted by you for processing.
"Output" means content generated, transformed, or returned by DreamFlix in response to your Input.
6.1 Your Use of Outputs
Subject to these Terms, applicable law, and third-party rights, you may use Outputs generated through your account for personal or commercial purposes.
ELDRAGA does not claim ownership of your Outputs merely because they were generated through DreamFlix.
However, you understand that:
- AI-generated content may not qualify for intellectual-property protection;
- the legal status of AI-generated content varies by jurisdiction;
- an Output may contain elements that are not owned by you;
- an Output may unintentionally resemble existing works or other generated content;
- similar or identical Outputs may be generated for different users; and
- DreamFlix does not guarantee that any Output is unique, original, copyrightable, trademark-safe, or free from third-party rights.
You are responsible for determining whether an Output is suitable and lawful for your intended use.
6.2 No Guarantee of Exclusivity
Because artificial-intelligence systems may produce similar results from similar Inputs, DreamFlix does not guarantee that an Output is exclusive to you.
Another user may receive an Output that is similar or substantially similar to yours.
6.3 Human Review
You are responsible for reviewing Outputs before publishing, distributing, selling, licensing, or otherwise relying on them.
DreamFlix does not guarantee that Outputs are:
- accurate;
- factually correct;
- legally compliant;
- appropriate for a particular purpose;
- free of defects;
- free of offensive or unwanted material;
- free of third-party intellectual-property rights; or
- suitable for commercial use in every jurisdiction.
7. AI Providers and Third-Party Technology
DreamFlix may use third-party artificial-intelligence and technology providers, including ByteDance, OpenAI, and Google, as well as hosting, computing, storage, analytics, payment, security, and other service providers.
Depending on the feature you use, your Inputs, Your Content, Outputs, and related technical information may be processed by one or more third-party providers.
Third-party providers may have their own:
- terms of service;
- acceptable-use policies;
- privacy policies;
- data-processing terms; and
- technical limitations.
Where applicable, you agree to comply with the rules governing the particular third-party AI technology used through DreamFlix.
The availability or performance of a particular third-party model is not guaranteed.
A third-party provider may change, limit, suspend, or discontinue access to its services, which may affect DreamFlix.
8. AI Model Improvement and Training
DreamFlix and its technology providers may use certain information for research, development, safety, quality assurance, analytics, service improvement, or AI-model improvement where permitted by applicable law and the applicable service configuration or provider terms.
The precise treatment of data may vary depending on:
- the AI provider;
- the particular model or API;
- the account or service configuration;
- the applicable contractual terms; and
- applicable law.
DreamFlix does not represent that every third-party AI provider uses every Input or Output for model training.
For additional information about DreamFlix's handling of personal information and user content, see our Privacy Policy.
9. Acceptable Use
You may use DreamFlix only for lawful purposes and in accordance with these Terms.
You must not use DreamFlix to:
9.1 Illegal or Harmful Activity
Create, upload, distribute, or facilitate content or activity that:
- violates applicable law;
- facilitates criminal activity;
- threatens or exploits another person;
- fraudulently impersonates another person;
- facilitates identity theft;
- facilitates harassment or targeted abuse;
- promotes or facilitates violence against individuals;
- facilitates self-harm or suicide;
- facilitates exploitation of minors; or
- otherwise creates an unlawful or serious risk of harm.
9.2 Sexual Exploitation and Non-Consensual Content
You must not use DreamFlix to create, distribute, or facilitate:
- sexual content involving minors;
- sexualized depictions of minors, whether real or synthetic;
- non-consensual intimate imagery;
- sexually explicit deepfakes of a person without appropriate consent;
- sexual impersonation intended to deceive or harm; or
- content intended to exploit, abuse, or sexually humiliate another person.
9.3 Privacy and Personal Information
You must not use DreamFlix to unlawfully collect, expose, infer, or distribute another person's sensitive personal information.
You must not submit:
- passwords;
- authentication credentials;
- financial account credentials;
- government identification numbers;
- highly sensitive health information; or
- other sensitive information
unless doing so is lawful, necessary for the particular feature, and permitted by applicable law.
9.4 Intellectual Property
You must not use DreamFlix to infringe, misappropriate, or unlawfully exploit another person's:
- copyright;
- trademark;
- patent;
- trade secret;
- publicity rights;
- personality rights;
- privacy rights; or
- other proprietary rights.
9.5 Fraud and Deception
You must not use DreamFlix to intentionally create deceptive media for fraud, impersonation, financial scams, identity theft, or other unlawful deception.
9.6 Security Abuse
You must not:
- introduce malware;
- attack or disrupt the Service;
- probe or bypass security systems;
- attempt unauthorized access;
- interfere with other users;
- exploit vulnerabilities;
- conduct denial-of-service attacks;
- circumvent authentication; or
- otherwise compromise the security or integrity of DreamFlix or its infrastructure.
9.7 Circumventing Restrictions
You must not attempt to circumvent, disable, bypass, or defeat:
- safety systems;
- content filters;
- usage limits;
- rate limits;
- account restrictions;
- access controls;
- technical safeguards; or
- other limitations imposed by DreamFlix.
10. AI Disclosure and Synthetic Media
Where applicable law requires disclosure that content was generated or manipulated using artificial intelligence, you are responsible for making that disclosure.
You must not falsely represent AI-generated or AI-manipulated content as entirely human-created where such representation would be unlawful, deceptive, or misleading.
DreamFlix may apply metadata, provenance information, watermarking, or other indicators to certain Outputs.
Where technically and legally applicable, you must not intentionally remove or falsify such provenance indicators for the purpose of misleading others about the origin of an Output.
11. Faces, Voices, Likeness, and Other People
If you upload a photograph, video, audio recording, or other material containing another person's face, voice, likeness, or personal information, you represent that you have obtained all permissions, releases, consents, or other legal authority required to do so.
You are responsible for ensuring that your use of another person's:
- image;
- likeness;
- voice;
- identity;
- personal information; or
- other identifiable characteristics
does not violate applicable law or the person's rights.
DreamFlix does not authorize you to impersonate another person simply because our technology allows you to generate or transform content resembling that person.
12. Content Moderation and Safety
We may use automated systems and, where appropriate, human review to detect content or activity that may violate these Terms, applicable law, or our safety requirements.
We may, where reasonably necessary:
- refuse to process a request;
- restrict a generation;
- remove content;
- limit an account;
- suspend an account;
- terminate an account;
- investigate suspected violations; or
- report suspected unlawful activity to appropriate authorities.
We are not obligated to monitor every piece of content submitted to DreamFlix.
If you are signed in, you can report a published movie by pressing Report this movie on its page. Anybody can also report content by contacting support@dream-flix.com. Our support team looks into every report.
The fact that content is not detected, removed, or blocked does not mean that it is permitted under these Terms.
13. Public Content
Some DreamFlix features may allow you to publicly share projects, images, videos, profiles, prompts, or other material.
If you choose to make content publicly available, you understand that other people may be able to:
- view it;
- copy it;
- download it;
- save it;
- modify it;
- redistribute it; or
- otherwise use it.
You are responsible for choosing appropriate sharing and privacy settings.
You should not publicly share personal information or other material that you expect to remain confidential.
13.1 Publishing a Movie
When you publish a movie, you ask DreamFlix to show it to the public. Every movie is reviewed by DreamFlix before it appears on Stream, and only a movie we approve is shown. We may decline to publish a movie, and may remove a published movie at any time.
Approval by DreamFlix does not make us responsible for your movie, and does not change your responsibility for it under these Terms.
13.2 License for Published Movies
While your movie is published, you grant ELDRAGA a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, stream, distribute, and publicly perform your movie, its scenes, its Movie Poster, its title, its synopsis, the pictures and short excerpts made from them, and your display name:
- on DreamFlix, including Stream, the movie's own page, and the DreamFlix player;
- together with advertising shown before, during, or around your movie; and
- in promoting DreamFlix.
This license includes the right to make the copies, formats, sizes, and excerpts needed for these purposes.
ELDRAGA keeps all revenue from advertising shown with published movies. You are not entitled to any payment or share of that revenue.
This license ends when you unpublish or delete your movie, or when we remove it, except for copies that have already been distributed, and copies kept as described in section 28.
You keep whatever rights you have in your movie.
14. Intellectual Property Owned by ELDRAGA
Except for Your Content and Outputs as described in these Terms, DreamFlix and its underlying technology are owned by ELDRAGA or its licensors.
This includes, as applicable:
- website design;
- software;
- source code;
- interfaces;
- branding;
- logos;
- trademarks;
- service names;
- documentation;
- databases;
- proprietary technology;
- platform architecture; and
- other materials supplied by or on behalf of ELDRAGA.
You may not copy, reproduce, modify, reverse engineer, distribute, sell, lease, sublicense, or commercially exploit DreamFlix itself except as expressly permitted by these Terms or applicable law.
Nothing in these Terms transfers ownership of ELDRAGA's intellectual property to you.
15. Feedback
If you voluntarily provide suggestions, ideas, feature requests, bug reports, reviews, or other feedback regarding DreamFlix ("Feedback"), you grant ELDRAGA the right to use, reproduce, modify, adapt, publish, and otherwise use that Feedback for lawful business purposes without compensation or attribution to you.
We are not required to use any Feedback you provide.
16. Credit and Paid Services
DreamFlix's generation services are paid for with credit. You buy credit in advance, in US dollars, from your Account page, and you spend it on generations. Every Generate button shows its price in credit before you press it.
Watching published movies is free.
By buying credit, you authorize DreamFlix and its payment processor to charge the payment method you provide for the amount you choose.
16.1 Stripe
DreamFlix uses Stripe for payment processing.
Your payment information may be collected and processed directly by Stripe.
Payments may be subject to Stripe's terms and privacy practices in addition to these Terms.
DreamFlix is not responsible for the failure of your bank, card issuer, payment method, or third-party payment service to authorize a transaction.
16.2 Taxes
Prices may not include applicable sales, use, value-added, goods-and-services, harmonized, or other taxes unless expressly stated.
Where required by law, taxes will be added to your purchase.
You are responsible for applicable taxes associated with your purchase except taxes imposed directly on ELDRAGA's income.
16.3 Your Credit
Credit you buy:
- never expires;
- is not refundable;
- cannot be exchanged for cash; and
- cannot be transferred to another account.
A generation that fails is not charged: the credit it held is returned to your account.
If you delete your account, any credit left on it, including credit you paid for, is forfeited and is not refunded.
17. No Subscriptions
DreamFlix does not sell subscriptions and never charges you automatically. You are charged only when you buy credit yourself.
18. Refunds and Cancellations
Credit is not refundable, except where applicable law requires a refund.
Nothing in these Terms limits a consumer's mandatory statutory rights.
If you dispute a payment with your bank or card issuer, or a payment for credit is refunded, we may suspend the account that bought the credit while we look into it.
If you believe you have been incorrectly charged, contact:
Please include the email address associated with your account and relevant transaction information.
19. Promotions
DreamFlix may occasionally offer promotional pricing, discounts, bonus credits, or other promotions.
Promotional offers may be subject to additional terms disclosed when the offer is presented.
Unless otherwise stated, promotional benefits:
- may be limited to eligible users;
- may not be transferred;
- may have expiration dates;
- may not have cash value; and
- may be withdrawn where permitted by law.
20. Service Availability
DreamFlix is provided on an "as available" basis.
We do not guarantee that the Service will:
- be available at all times;
- be uninterrupted;
- be error-free;
- be compatible with every device;
- process every request;
- produce a particular quality level;
- produce results within a particular amount of time; or
- remain available in every country or jurisdiction.
The Service may be temporarily unavailable because of:
- maintenance;
- upgrades;
- technical failures;
- security incidents;
- network failures;
- third-party infrastructure problems;
- AI provider outages;
- excessive demand;
- regulatory requirements; or
- circumstances beyond our reasonable control.
21. Third-Party Services
DreamFlix relies on third-party services and infrastructure, including AI technology providers, payment providers, analytics providers, hosting services, and other vendors.
Third-party services may change or become unavailable without our control.
DreamFlix may contain links to third-party websites or services.
We do not control third-party websites or services and are not responsible for their:
- content;
- availability;
- security;
- privacy practices;
- terms;
- products; or
- services.
Your use of a third-party service may be subject to that provider's separate terms and policies.
22. No Professional or Legal Advice
DreamFlix's Outputs and information made available through the Service do not constitute legal, medical, financial, professional, or other specialized advice.
You should not rely upon an AI-generated Output as a substitute for advice from an appropriately qualified professional.
23. Disclaimer of Warranties
To the fullest extent permitted by applicable law, DreamFlix and the Service are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, ELDRAGA disclaims warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties or conditions relating to:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- accuracy;
- availability;
- reliability;
- quality;
- security;
- uninterrupted operation; and
- suitability for a particular purpose.
We do not warrant that Outputs will be accurate, unique, lawful, original, copyrightable, or suitable for your intended use.
Nothing in these Terms excludes or limits any warranty, condition, right, or remedy that cannot lawfully be excluded or limited under applicable consumer-protection law.
24. Limitation of Liability
To the fullest extent permitted by applicable law, ELDRAGA and its owners, officers, employees, contractors, service providers, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, business opportunities, goodwill, or data arising out of or relating to:
- your use or inability to use DreamFlix;
- Outputs generated through the Service;
- Your Content;
- unauthorized access to your account;
- third-party services;
- interruptions or failures of third-party infrastructure;
- loss or corruption of data;
- suspension or termination of your account; or
- any other matter relating to the Service.
To the fullest extent permitted by applicable law, ELDRAGA's aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:
(a) the amount you paid to ELDRAGA for the Service during the six (6) months immediately preceding the event giving rise to the claim; or
(b) CAD $100.
This limitation does not apply to liability that cannot legally be limited or excluded, including liability that applicable law prohibits us from limiting.
Nothing in these Terms is intended to exclude or restrict mandatory rights available to consumers under applicable law.
25. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless ELDRAGA and its officers, directors, employees, contractors, licensors, service providers, and affiliates from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising out of or relating to:
- Your Content;
- your violation of these Terms;
- your violation of another person's rights;
- your unlawful use of the Service;
- your misuse of Outputs;
- your violation of applicable law; or
- your intentional or negligent misuse of DreamFlix.
This section does not require you to indemnify ELDRAGA for ELDRAGA's own liability to the extent such indemnification would be prohibited by applicable law.
26. Account Suspension and Termination
You may stop using DreamFlix at any time.
We may suspend or terminate your account if:
- you materially breach these Terms;
- you engage in unlawful conduct;
- you violate our content or safety requirements;
- your use creates a security risk;
- you attempt to circumvent technical restrictions;
- you engage in fraud or payment abuse;
- required by law; or
- necessary to protect DreamFlix, ELDRAGA, our users, or third parties.
Where appropriate and reasonably practicable, we may provide you with an opportunity to correct a violation before terminating your account.
For serious violations, we may suspend or terminate access immediately.
27. Effect of Termination
When your account is terminated or deleted, your right to use DreamFlix ends.
Subject to applicable law and the Privacy Policy, content associated with your account will be deleted from DreamFlix systems as described below.
You remain responsible for obligations that by their nature survive termination, including provisions concerning:
- intellectual property;
- payment obligations;
- disclaimers;
- limitations of liability;
- indemnification; and
- dispute resolution.
Termination does not invalidate rights or obligations that arose before termination.
28. Account and Content Deletion
You may delete your account or content through available DreamFlix account controls or by contacting:
DreamFlix is designed to delete applicable user content from its active systems immediately upon deletion.
ELDRAGA does not intentionally maintain backup copies of deleted DreamFlix user content.
However, information may continue to exist temporarily or independently within third-party systems where deletion is governed by those providers' own technical processes, contractual obligations, or legal requirements.
Certain information may also be retained where required by law or reasonably necessary for legal claims, security, fraud prevention, accounting, or regulatory compliance.
For additional information about the handling and deletion of personal information, see our Privacy Policy.
29. Copyright and Intellectual Property Complaints
ELDRAGA respects intellectual-property rights.
If you believe content available through DreamFlix infringes your copyright or other intellectual-property rights, please contact:
Your notice should provide enough information for us to identify:
- the work or right allegedly infringed;
- the material at issue;
- where the material appears;
- your contact information;
- your relationship to the relevant rights; and
- the basis of your claim.
We may remove or restrict access to content where appropriate and may take action against repeat infringers.
Nothing in this section prevents us from responding to notices or claims according to applicable law.
30. Electronic Communications and Agreement Acceptance
By using DreamFlix electronically, you consent to receiving contractual notices, account notices, purchase confirmations, policy updates, and other communications electronically where permitted by law.
Electronic acceptance, including clicking an "I Agree," "Create My Account," or similar button, may constitute acceptance of these Terms where applicable.
Where required by law, we will provide you with a copy of the applicable agreement or other required contractual information in a manner that allows you to retain it.
31. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide notice through DreamFlix, by email, by posting notice on the website, or through another legally appropriate method.
The "Last Updated" date at the beginning of these Terms identifies the current version.
Where applicable law requires affirmative acceptance of a change, we will request that acceptance.
If you do not agree to a revised version of these Terms, you should stop using DreamFlix before the revised Terms become effective.
32. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
However, if you are a consumer residing in a jurisdiction that grants you mandatory consumer-protection rights that cannot legally be waived by contract, those rights remain unaffected.
Nothing in these Terms is intended to prevent you from relying on mandatory rights or protections available under the laws applicable to you.
33. Dispute Resolution
We encourage you to contact us first regarding any dispute or concern.
You may contact:
We will make reasonable efforts to resolve disputes informally.
Where a dispute cannot be resolved informally, and subject to any mandatory rights or procedures available to consumers under applicable law, the dispute may be brought before a court of competent jurisdiction.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where legally available.
34. Force Majeure
ELDRAGA will not be responsible for failure or delay in performing obligations caused by circumstances beyond our reasonable control, including:
- natural disasters;
- severe weather;
- war;
- terrorism;
- civil unrest;
- government action;
- pandemics;
- power failures;
- internet outages;
- telecommunications failures;
- cyber incidents;
- failures of hosting providers;
- failures of AI providers;
- failures of payment providers;
- labour disputes; or
- other events beyond our reasonable control.
35. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by law.
ELDRAGA may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, or similar transaction.
36. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted to the maximum extent permitted by law, and the remaining provisions will continue in effect.
The invalidity of one provision does not automatically invalidate the remainder of the Agreement.
37. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
Any waiver must be made in writing where required by law.
38. Entire Agreement
These Terms, together with the DreamFlix Privacy Policy and any additional terms expressly incorporated into the Service, constitute the agreement between you and ELDRAGA concerning your use of DreamFlix.
Where a specific paid product or feature has separate terms presented to you at the time of purchase, those terms will apply to that product or feature to the extent of any conflict.
